Effective Control and the Reach of the Acquis: EU Membership with Territory Under Occupation

Activity: Participating in or organising an event › Invited talk

Description

The Ukrainian Catholic University (Lviv) invited me to give a talk with the title: "Effective Control and the Reach of the Acquis: EU Membership with Territory Under Occupation"

Abstract
The European Union has repeatedly had to decide how its law applies to territory that a state claims but does not control. Cyprus, Kosovo, Transnistria and Western Sahara have each produced a distinct legal technique: suspension of the acquis where a government lacks effective control, engagement with unrecognised authorities that stops short of recognition, sovereignty disclaimers that quarantine the underlying claim, and a requirement of consent from the people of the territory concerned. This lecture sets out that repertoire and asks which parts of it remain available where the territory is under occupation and the accession process is already under way.
